How can my friend's daughter defend herself against fraudulent accusations that she caused an accident?
A friend’s daughter and her family were sitting in her car in a public car park when they were hit by a reversing vehicle. The lady driver said that she was extremely sorry and full of apologies and details were exchanged. The same evening the lady’s husband rang the daughter and asked if she was willing to settle on a 50/50 basis. As the innocent party she declined, at which point the caller put the phone down. As the car is only valued at £1,000 and the estimated repair costs are £1,300, her insurers have declared the car a write off. The lady has now told her insurers that the daughter caused the accident and sadly there were no independent witnesses. Are you able to offer any suggestions how she might proceed in this matter?

Accuse the other driver of lying through her teeth and take the matter to court, suing her for full restitution and for all your costs. Remind her that if she lies in court she could get a prison sentence for perjury. Tell your insurer you are going to adopt this approach and, if it will not back you up, you will sue the other party directly yourself.
