I was stopped for driving above the legal speed limit on 19th June 2012 and received a fixed penalty notice. It states at the bottom that providing I produce and am prepared to surrender a valid driving licence and then pay the sum of £60 pounds then no further action will be taken. I duly went to my local Police station and surrendered my licence on 21st June and got a receipt for same. I then contacted the appropriate telephone number and made the required payment (which has subsequently been shown on my credit card statement). At this point I assumed the matter closed and that I would receive my licence duly endorsed in due course. Alas this turned out not to be the case. After many frustrating calls to the same local Police station they finally admitted that my licence must be lost and unfortunately there was no way of proving whether it had been lost by the Police, the postal authorities or the DVLA. I was told the only course of action open to me was to pay the £20 fee and apply for a replacement licence. This I did and it was issued on 31st August 2012.

To my astonishment I recently received a summons to appear before a Magistrates Court on 8th October 2012. I wrote to the Court administration service and sent them copies of all the evidence supporting my story but I have so little time between receipt of the summons and my appearance I am not hopeful of an answer. Whilst gathering said evidence I noticed that the original payment had been refunded on a later card statement and that my licence had not been endorsed.

I had to return the court form pleading guilty or otherwise which I did (pleading guilty). Will I get a chance in court to show what has gone on and do you consider there to be a chance they will revert to the original fixed penalty fine and points
