Problem with BMW 1 Series jolting back in first gear

A colleague at work has had problems with his 1 series BMW (manual) jolting back in first gear. After breaking heavily due to a car pulling out at a roundabout he took the car out of gear, then back into first - and it jumped back. This happened twice and as a result he hit a vehicle behind him.

I believe him that he didn't select reverse by mistake. BMW has no solution, and deny any known problem. Any suggestions?

Reverse is beside first so he got reverse instead of first. Could be the spring to stop this happening has failed.
