Insurance 'write-off' with Hastings Direct

I had an accident on the M25 two weeks ago, driving into a large lorry tyre, dropped by a lorry. Highways Agency attended and told me to give the lorry details to my insurers as it was clearly their fault.

My insurers, Hasting Direct, took the car from my home (I was recovered by AA) 3 days later & had their engineer assess it. Now they are telling me it is a write off despite being roadworthy but with cosmetic damage (bumper, grill and mask panel).

The say repair costs would be about £700 therefore not economically viable (the car is 1998 with 149,000 miles but is mechanically very sound). Hastings want me to send them V5 doc, latest MOT certificate, insurance certificate, copy of my driving license, full service history and original purchase receipt before they will give me a value on the car!

Can this be right? I want my car back! Also Hastings have made little if any effort to claim from the lorry insurers. Do I need to get legal assistance?

Tell them you want your car back and tell them you do not want it written off. Tell them to make you a financial settlement towards the cost of repairing the car that will be the £700 minus the salvage value of the car.
