Heart attack driver hit my car - who pays the bill?
My car was parked on a road and a driver going past had a heart attack at the wheel and hit my car. This driver died at the scene. I made an insurance claim and went ahead with the repair until liability was confirmed.
I thought there would not be an issue about liability. My insurer has contacted me to say that it may not be a claim against the other driver as she was not necessarily negligent by having a heart attack.
Surely the other insurer has to cover the claim?

She was negligent in driving the car in a medical condition in which she could have a heard attack.
