Nissan will not adjust their compensation for my daughter's Qashqai's differential fault.
I wrote to you in May regarding problems my daughter was experiencing with regard to the differential of her Nissan Qashqai and the amount of compensation Nissan was prepared to pay. You kindly provided me with details of a similar occasion when the offer of compensation was considerably higher. You also advised me on how best to pursue the matter. On approaching the trader they suggested we contact Nissan direct. This we subsequently did, giving them details of the apparently identical problem and the difference in the respective amounts of compensation. In reply they have stated that they were not willing to discuss the details of the other incident and did not intend to increase their offer. Do you think we have come to an end with this matter and that we have nowhere else to go?

You could attempt to invoke Sale of Goods against the original dealer using the six years' expected life argument and the raised £10,000 limit for the Small Claims Track of the County Court. At this point, Nissan might capitulate or might back the dealer to fight this through to appeal. See: www.honestjohn.co.uk/faq/consumer-rights/
