Ford Focus leaking water but deal won't help - what should I do?

We bought our Ford Focus from new 16 months ago. Recently we noticed the footwells and the spare tyre in the bootwell had taken in water. We contacted our dealership whom said this was nothing to do with them, we then booked the car into the warranty repair garage for Ford and the mechanics determined that at some point the car had been in an accident, unbeknown to us, further more the bumper had been replaced but not the rear back panel had not hence the water intake.

This damage did not happen whilst in our care and I have asked both the dealership and Ford to investigate - with neither stating anything positive.
Now we are being told that water intake is not covered after the first year of warranty and we have to pay for the repairs.

However as stated above this damage did not occur while in our care and I am really unhappy with the attitude of both the dealership and the manufacturer. What should we do?

You can take the original dealer who supplied the car to court claiming that it was supplied faulty and citing the House of Lords 2003 ruling in Clegg v Olle Andersson. I don't think they will even attempt to defend the indefensible. Law here: www.honestjohn.co.uk/faq/consumer-rights/

Obviously let them know beforehand that this is what you intend to do and give them a chance to change their minds. (If the car was damaged at the rear, then the one-way cabin vent flaps between the lower sides of the boot and the rear bumper valence extensions were probably damaged and that is probably how the water is getting in.)
