I bought a 1993 Mercedes-Benz 190 LE which needs work on the rear brakes. Should the dealer pay?
I bought a 1993 Mercedes-Benz 190 LE 2.0 about one and a half months ago. It has now developed a loud vibrating/rubbing noise upon braking. I bought the car from a dealer with 12 months' MOT. My technician has found that the near-side rear brake disc is scarred and completely rusted, and I was advised that the car should not have passed it MOT. Where do you think I stand with this? Is it worth me taking this further or shall I just get over the £80 it will cost me to change the pads and discs?

The disc and pads need changing, but to get anything from the other dealer you would need to give them the chance to undertake the repair. This is one which is marginal. It seems likely that there was a problem with the disc before you bought the car, but it is 17 years old and these are wearing parts. Sale of Goods legislation states that the age, mileage and price of the car should be taken into account. If it was me I would give the dealer a break (no pun intended) and pay it myself.
