New Car

I have just purchased a brand new Mini from BMW. I opted out of BMW seal&protect and took it to my reputable detailing company for a seal&protect. This was when the flaws appeared, in preparing the vehicle the detailer noticed as follows - the factory or dealer had left wax residue over the rubbers, light washing and swirl marks, but worst of all was the drivers rear wing which had bad evidence of machine polishing trying to hide a scratch, which had been touched in (using the wrong colour paint). I would not expect this from a main dealer on a brand new vehicle. They have of course said they will rectify the problem, but this has totally destroyed any trust in them. Would I be within my rights to ask for a refund or replacement?

No, not if they have offered to rectify the faults FOC. However, if they do not do this in a "satisfactory" manner you can reject the car.
