Okay, question for you guys.

Three cars have been dumped in our communal residents parking, which is accessible from the street.

Two of them have been dumped by people who live in council houses on the opposite side of the street and who pay no rent for the communal parking on our privately owned side of the street.

Both cars are on SORN, which allows cars which are not taxed, not insured and not MoTd to be kept "off the road".

The Clio is plainly knackered, sitting on flat tyres and isn't going anywhere soon.

The Xsara Picasso has collapsed rear suspension and is not roadworthy.

The third is a 'BG' registered Mercedes C-Class Coupe that actually looks quite tidy, but has not moved for 6 months. But may/may not be owned by someone renting a house on our side of the street.

This means that three valuable off road private parking spaces are being taken up by cars at least two of which have no right to be there.

So what to do that would not cause a council purge on all sidewalk parking in the area that would create an even greater problem?

Is there any legal way to get rid of the dumped cars?

Would everyone who collectively owns/rents the residents parking spaces have to be petitioned?

Is that the only way?

Pay for them to be removed to a safe place of "storage"...

I am sure you can legally find out who the owners are, advise them that the cars need to be removed in xxx days and then just do that.

I dropped the hint with a neighbour that the council were lookin at the cars in our street/private parking areas and one of them moved and the other was moved nto the owners reseved parking space.

HJ.. time to get the car park cowboys involved and bill them HUNDREDS>>>>

What steps would you take to deal with illegal parkers using taxed, insured, MoT's cars? That same method could be used in this case.

The "wrong" answer is to find a black market scrap-yard and get them to scrap them.

According to my local council:

::Under the Refuse Disposal (Amenity) Act 1978 (which has since been amended by numerous Acts and Regulations), local authorities have a duty to remove a vehicle that has been abandoned on any open land or on any road to which the public have access. They can also charge for its removal, storage (if appropriate) and disposal.::

Does your council provide similar advice?

Not sure what they could do if the vehicles are now on private land - I wouldn't be surprised if the council washed their hands of it, saying its the responsibility of the (private) land owner or their managing agents.

Its the reason why, on the private development where I live (an am a resident director [not any financial ownership BTW] - just jointly in charge of how monies collected are raised/spent for the running of the development) we have a parking firm look after enforcement. Unfortunately we haven't had any similar issues - the nearest was a resident who sorned their car and left it neglected in their space for 2 years. A quiet word helped resolve the situation...

HJ could try going to the land owner or residents association/managing agents to see if they would do the honours if the council doesn't - I would suspect evidence (photos and witness statements as well as DVLA info) would be needed before taking it further to remove the cars at the owners' expense. Quite often, when people who park on my development for the station (nearby) etc without a permit (genuine visitors to homes only), they don't want to pay the fine and get debt collected, which could be done in this case. Word often 'gets round' if this happens, and things quieten down for a while again.

HJ might be unlucky if its a 'dodgy' council estate nearby, as some residents have been known in such areas to 'take matters into their own hands' if persued by parking firms, debt collectors, etc if you get my drift, especially if they found out who it was who'd taken the action.

If the resident's car park has public access, is not gated or access is not restricted by a barrier it is in legal terms equivalent to a public road, so insurance and road tax are mandatory.

That's covered by the term "on any open land or on any road to which the public have access"

In our modern build estate all communal parking and park land was adopted by the local authority after a period of time which is as I understand it quite normal. Call the local council and ask. If they have adopted responsibility for said land then the cars are parked there illegally (it will be classed as public highway) and the police can charge the owners.

Long shot thought, need a lateral thinking legal expert to see whether the illegal dumping of rubbish legislation could be extended to motor vehicles .... fly tipping?
